Early Access Terms

These terms cover joining Xaviour Early Access and, if you are invited, using the Xaviour product with a connected Google account. They are written for the stage Xaviour is actually at: pre-release, small, and changing.

1. Who we are

Xaviour is operated by Xaviour AI Limited ("Xaviour", "we"), a private company limited by shares, registered in Ireland.

2. Early Access is a pre-release stage

Xaviour is not a finished product. Early Access is a beta: features are incomplete, may change substantially, and may be added or removed. We do not promise uninterrupted or error-free availability, and there may be downtime or periods where the product is unavailable while we work on it.

Access opens gradually. Joining the Early Access list registers your interest; it does not create an account and does not by itself grant access to the product. Access is granted in stages and may be invite-only at any given time.

3. Founding Cohort

Up to 30 Early Access participants will be invited to join Xaviour's Founding Cohort, which receives three months of Xaviour free and a closer feedback relationship with the founder while the product's earliest stage is shaped. Invitations are issued individually at our discretion, and each place is allocated once, in order, up to a maximum of 30. Joining the Early Access list does not guarantee a Founding Cohort place.

Founding Cohort participation is a product programme only. Participants are not founders, shareholders, owners or investors of Xaviour AI Limited, and it confers no ownership, equity, shareholding, profit share, governance right or founder status of any kind.

An offer may change before it is confirmed to you. Once we have confirmed stated Founding Cohort benefits to you, we will honour them, unless we discontinue the service or the law requires otherwise.

3a. Using the Xaviour product

Xaviour is an AI-assisted communication system. It reads the Gmail and Google Calendar data you connect, proposes what to do, and acts only within the permissions you granted. Its suggestions, summaries and drafts can be wrong or incomplete.

• You remain responsible for reviewing anything consequential before it happens: what a draft says, who it goes to, and what a calendar event contains.
• Sending a message and creating a calendar event always require your explicit confirmation of that specific action inside Xaviour. Reversible organisation (labels, archiving, read state) runs under the settings and rules you approve, and can be undone.
• Xaviour never permanently deletes your mail and never asks for your Google password.
• You can disconnect Google inside Xaviour or revoke access from your Google Account at any time; Xaviour then cannot access anything further.
• Google-connected functionality is governed by these terms together with our Privacy Notice (Part A) and How Xaviour uses Google data, which describe exactly what is accessed, stored and shared.

4. Eligibility

You must be at least 18 and able to enter into a contract. If you join on behalf of an organisation, you confirm you are allowed to do so.

5. Your responsibilities and acceptable use

• Give accurate information when you register, and keep your email address current.
• Do not use Xaviour for anything unlawful, or to send or store content you have no right to.
• Do not attempt to break, probe, overload or reverse-engineer the service, or bypass its security.
• Do not share Early Access credentials or access with other people.
• Keep confidential any non-public information about unreleased features that you see during Early Access.

6. Feedback

Feedback is the point of Early Access. If you send us ideas, suggestions or reports, you allow us to use them freely to improve Xaviour, without obligation or payment. You keep all rights in your own content and communications — giving feedback transfers nothing else to us.

7. Intellectual property

Xaviour, its software, brand and this website remain ours. Early Access gives you a personal, revocable, non-transferable right to use the product during the Early Access period, and nothing more. Your data and your communication content remain yours.

8. Payment

Early Access is currently free and requires no payment details. Paid plans may be introduced separately. We will explain the applicable price and terms before you are charged. Joining Early Access does not itself authorise Xaviour to charge you.

9. Suspension and termination

You may leave at any time — email us and we will remove your registration or access. We may suspend or end Early Access participation, for example for breach of these terms, for security reasons, or if we end the Early Access programme. Where it is reasonable to do so, we will tell you first.

10. Liability

Early Access is provided free and as-is. To the extent the law allows, we exclude liability for indirect or consequential loss, and for loss of profit, revenue or data arising from Early Access use. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot lawfully be excluded. Nothing here removes your statutory rights as a consumer, or your rights under data protection law.

11. Privacy

How we handle your information — including the Gmail and Calendar data you connect in the product — is set out in our Privacy Notice and How Xaviour uses Google data, and cookies in our Cookie Policy.

12. Changes to these terms

We may update these terms as Xaviour develops. The date at the top always shows the current version, and we will tell participants by email about material changes.

13. Governing law

These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction. If you are a consumer resident in the EEA or the UK, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of your right to bring proceedings before your local courts.
